These Terms and Conditions ("Terms") govern your access and use of the futuREproof website (the "Website"), mobile application (the "App"), and the reusable packaging service (the "Service") offered by futuREproof (the "Company").

1. Acceptance

By accessing or using the Website, App, or Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Service

2. Use of the Service

2.1 Eligibility: You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service.

2.2 Deposit and Payment: You may be required to pay a deposit for each reusable container you borrow. Payment methods will be available on the App.

2.3 Borrowing and Returning Containers:

• You can find collection points for returning containers through the App. Only containers listed in the App can be returned at these points.
• You are responsible for using the containers with care. Normal wear and tear is expected, but you may be liable for the full deposit or excluded from the Service for severe damage.
• You must return containers within the specified time frame. Failure to do so may result in additional charges.

2.4 The App: The App allows you to manage your account, locate collection points, and track your container usage. You are responsible for maintaining the confidentiality of your login credentials.

3. User Data

3.1 Data Storage: We store your personal data on a secure server within the EU.

3.2 Payment Information: Payment information is encrypted and stored by our partner Stripe. We do not have access to this data.

3.3 Data Sharing: We will not share your personal information with third parties except as necessary to provide the Service or comply with legal requirements.

3.4 Account Deletion: You have the right to delete your account at any time.

4. Disclaimers

4.1 The Service is provided "as is" and without warranties of any kind, express or implied.

4.2 We do not guarantee the availability or functionality of the Website, App, or Service.

4.3 We are not liable for any damages arising from your use of the Service, including but not limited to, damage to your device or foodborne illness.

5. Limitation of Liability

Our liability to you for any loss or damage arising from these Terms or your use of the Service will be limited to the amount of the deposit you paid, to the extent permitted by law.

6. Intellectual Property

The Website, App, Service, and all content therein are protected by intellectual property rights, including copyrights, trademarks, and patents. You may not use any of these materials without our prior written consent.

7. Termination

We may terminate your access to the Service for any reason, at any time, with or without notice.

8. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of Belgium. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Belgium.

9. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the Service and supersede all prior or contemporaneous communications and proposals.
